PUBLIC NOTICE
INTENT TO ADOPT A NEGATIVE DECLARATION
CITY OF SAN JOSE, CALIFORNIA

Project Name:  Capitol Avenue General Plan Amendment
File No.: GP19-004

Description: General Plan Amendment to change the General Plan Land Use Designation of a 0.44-gross acre parcel on the east side of Capitol Avenue in the City of San José from Neighborhood Community Commercial to Mixed Use Neighborhood. The Mixed Use Neighborhood allows for up to 30 dwelling units per acre (du/ac) and a Floor Area Ratio (FAR) range of 0.25 to 2.0. A specific development project is not proposed at this time.

Location: East side of Capitol Avenue, approximately 250 feet north of Alum Rock Avenue in the City of San José

The City has performed an environmental review of the project.  The environmental review examines the nature and extent of any adverse effects on the environment that could occur if the project is approved and implemented.  Based on the review, the City has prepared a Draft Negative Declaration (ND) for this project. A ND is a statement by the City that the project will not have a significant effect on the environment without the need for mitigation measures. The project site is not included on a list of hazardous materials sites compiled pursuant to Section 65962.5 of the California Government Code. The public is welcome to review and comment on the Draft ND.

The public comment period for this Draft ND begins on Friday, September 27, 2019 and ends on Wednesday, October 16, 2019.  The Draft ND, Initial Study, and reference documents are available online at: www.sanjoseca.gov/negativedeclarations. 

The documents are also available for review from 9:00 a.m. to 5:00 p.m. Monday through Friday at the City of San José Department of Planning, Building and Code Enforcement, located at City Hall, 200 East Santa Clara Street; the Dr. Martin Luther King, Jr. Main Library, located at 150 E. San Fernando Street.
