The
Council of the City of San Jose reconvened in Regular Session at 7:05 p.m. in
Council Chambers at City Hall to conduct public hearings on the San José 2020
General Plan.
Present: Council Members: Chavez, Cortesé, Dando, Diquisto, LeZotte, Reed, Shirakawa Jr., Williams, Yeager; Gonzales

PUBLIC HEARINGS
Mayor Gonzales welcomed everyone to the Public Hearing on proposed amendments consisting of changes to San José 2020 General Plan text and land uses in conjunction with the Housing Opportunity Study Phase I and other items deferred from the November 2000 Annual Review. He outlined the order Agenda items would be considered by the City Council, and that any action taken will be considered as motions for tentative approval pending final adoption of the resolution amending the San José 2020 General Plan. He stated any item scheduled for hearing this evening for which deferral is being requested will be taken out of order and heard first on the matter of deferral. Upon motion by Vice Mayor Shirakawa, Jr., seconded by Council Member Williams and unanimously carried the below noted actions were taken. Vote: 10-0-0-0-1. Vacant: District 5.

General Plan Amendment to change
the Land Use/Transport-ation Diagram for property located on the north side of

Discussion/Action: Referencing the Berryessa School District’s letter identifying traffic safety issues of concern to the District, and the Orchard School District and the expansion of Orchard School to allow increased enrollment, Council Member Reed assured School District Administration that their concerns will be addressed. He stated traditional traffic studies are insufficient responses to traffic issues and that the impacts can best be mitigated by utilizing some of the efforts of the Traffic Calming Advisory Committee. He requested that City Planning continue to work with the Districts, as each project is presented to the Planning process, in order to accommodate increased enrollment resulting from intensified housing developments. Upon motion by Vice Mayor Shirakawa, Jr., seconded by Council Member Diquisto and unanimously carried, Resolution No. 70174, entitled: “A Resolution of the Council of the City of San José Making Certain Findings Concerning Impacts and Mitigation Measures Associated With Certain Specific Amendments to the General Plan of the City of San José, for Which the Housing Opportunities Study Phase I General Plan Amendments Environmental Impact Report Has Been Prepared in Accordance With the California Environmental Quality Act”, was adopted. Mayor Gonzales stated the Consent Calendar items
will be acted upon and adopted by one motion, unless either Council Members or

Discussion/Action: Council Member Cortesé stated the referenced property is located on the corner of an exceptionally busy intersection in the East Valley, queried Staff on ingress/egress issues, contemplated curb cuts for the area, and requested some examples of sites where these design techniques have been applied. Discussion/Action: Michelle McGurk, representing Shasta Hanchett and Buena Vista Neighborhood Associations, spoke in favor of recommendations proposed in the memorandum from Mayor Gonzales, and Council Members Chavez, Reed and Yeager. Jill Escher, representing Walk San José, spoke on the proposed text amendment. William J. Garbett spoke against residential development along transit corridors. Council Member Yeager stated the item as noticed on the Agenda is unclear and reflects extensive change that would affect areas in District 6 and throughout the City. He stated for the record that in the future when significant changes are made the Planning Commission Agendas should accurately reflect those changes so that the public can be adequately informed of the issues prior to attending Planning Commission, City Council, and community meetings. The recommendation of the Planning Director and the Planning Commission to modify the policies on building height was tentatively approved as outlined by Staff in the Housing Opportunity Study, but with revised limits for building heights in transit corridors to be set at 50 feet and 120 feet within 2,000 feet of existing and designated train stations; and when future LRT or BART stations are designated by Valley Transportation Authority, initiation of General Plan changes would occur to implement the 120-foot limit around newly designated stations. 00-T-27 General Plan Text Amendment to amend the "Land Use
Compatibility Guidelines for Community Noise in San Jose" to help protect
residential development in urban locations subject to high levels of noise.
(Staff). CEQA: Resolution No. 70174. Recommendation: Staff and Planning
Commission recommend adoption of the proposed text amendment.
Discussion/Action: In response to Council Member Dando’s concerns related to noise attenuations for homes located along rail lines, Mayor Gonzales pointed out that some trains will utilize existing rail corridors, and that City Staff would work with VTA administration to explore possible options for buffers for both new construction and existing homes, with continuing review of noise impacts as part of appropriate environmental impact reports for specific transit projects. With respect to noise impacts and mitigation measures, Council Member Chavez stated some areas identified for housing development do not contain freeways, or railroad tracks, or expressways; conversely, some neighborhoods contend with all three influences. She suggested that City Staff review the City’s best practices as they relate to construction materials used in soundwalls and buffers and the availability of those materials to the City, and explore mitigation measures that could be incorporated into the City’s development process. She requested that Staff select projects proposed in light rail areas, industrial and residential, in the core as well as outlining areas, and re-examine the measurement tools currently applied to noise levels. William J. Garbett spoke against the proposed amendment. The recommendation of the Planning Director and the Planning Commission to amend the Guidelines to help protect residential development in urban locations subject to high levels of noise was tentatively approved with Staff directed to clarify industry standards with regards to CNEL/DNL noise levels. 11.1.4(b) GP00-03-04

property located on the area north of Bassett Street between Market and Highway

Discussion/Action: Council Member Reed entered disqualification from discussion and decision on this matter because of a material impact on a source of income in excess of allowable return during the past year. Gary Veselka, representing TRENKA, UC, expressed concern regarding the compatibility of new development within existing zonings. With respect to Council Member Chavez’ request for an explanation of how Council can defer action on both items pending appropriate environmental review, Deputy Director of Planning Kent Edens explained the allowable height in the subject area, and whether the arbitrary height can be increased without posing an obstruction to the Airport Approach Zone. Pointing out the absence of an item on tonight’s Agenda specifically proposing a change in the height policy, as it relates to the proposed area, he stated the options available to Council would involve deferring both General Plan Amendments, pending completion of appropriate environmental impact review to make a change in the height policy, or approving the land use designation changes and referring the issue of potential change in the height policy to Staff for appropriate environmental review and report back to Council. Upon motion by Council Member Chavez, seconded by Vice Mayor Shirakawa, Jr. and unanimously carried, the recommendation of the Planning Director and the Planning Commission to change the Diagram to General Commercial on a 2.1 acre site was tentatively approved with Council Member Chavez’ recommendation that provided for the allowable height to be set by Federal Aviation Administration referred to Staff for report back to Council, pending appropriate environmental impact review.
