RECOMMENDATION

 

Approval of a Cooperation Agreement with the City of Cupertino for resurfacing De Anza Boulevard between Rainbow Drive and Prospect Road in an amount not to exceed $175,000.

 

BACKGROUND

 

DeAnza Boulevard, between Rainbow Drive and Prospect Road, is due for resurfacing in order to maintain the street in good condition.  The jurisdiction for this street segment is shared between the cities of Cupertino and San Jose – San Jose’s jurisdiction includes the east side of the street.

 

It is proposed that the two cities cooperate to implement a single maintenance project covering both jurisdictions.  The benefits of a single project include reduced cost, less construction impact, and improved overall street appearance.  A cooperation agreement between San Jose and Cupertino has been prepared describing the terms and conditions for implementing the shared street resurfacing project.

 

ANALYSIS

 

Under the proposed cooperation agreement, Cupertino will be the lead agency and responsible for preparing plans and specifications, administering the construction contract, and providing inspection services to oversee the construction.  San Jose will share in the total cost of the project. 

 

The scope of the project includes pavement resurfacing, traffic control, replacement of all traffic striping and signal detector loops, and adjustments to utility manholes, as necessary.  The cost of work in San Jose jurisdiction, including engineering, inspection, and contingencies, is estimated to not exceed $175,000.  Cupertino will bill San Jose for actual costs at the completion of the project.  In the event the project is terminated, San Jose would be responsible for incurred costs associated with the portion of the project in San Jose.

 

The Cupertino City Council has approved the cooperation agreement and the project is proposed to commence construction in September and be complete by December 2001.

This agreement has been coordinated with the Offices of the City Attorney and Risk Manager.

 

COST IMPLICATIONS

 

The total cost of the agreement is for an amount not to exceed $175,000.  Funding for the agreement is included in the Traffic Capital Budget under the line item titled “Street Maintenance”.
