a. Memorandum from Bert Robinson on Information that must be Disclosed
b. Memorandum from Bert Robinson and Lisa Herrick on the “Drafts” and ”Personnel” Exemptions
c. Memorandum from Bert Robinson on the “Litigation” and “Bids and Proposals” Exemptions

Action: Discuss exemptions under the California Public Records Act and develop Subcommittee recommendations

2. The Public Interest Test – the “Catch All” Exemption – a.k.a. the Balancing Test (including the Deliberative Process Privilege) (Government Code Section 6255)

Supporting Documents:

a. Memo from Chair Robinson re: 6255 Privilege
b. Memo from CAO Summarizing the Balancing Test
c. Proposed language eliminating the balancing test and identifying specific exemptions instead;
d. Proposed language modifying the balancing test.

Action: Review and approve proposed language and forward both documents to the December 6, 2007, SRTF meeting.
