RECOMMENDATION

 

Approval of the first amendment to the agreement for consultant services for the King Road Bridge at Penitencia Creek with Creegan + D’Angelo, extending the term from December 31, 2001 to December 31, 2003, at no additional cost to the City.

 

BACKGROUND

 

King Road Bridge at Penitencia Creek is a narrow two-lane bridge that is a roadway bottleneck that causes traffic congestion.  Public Works staff is presently designing a project that will replace the existing two-lane bridge with a new four-lane bridge and complete sidewalks on both sides of the structure.  Once completed, the new bridge will improve traffic capacity and safety. Attached is a map showing the location of the project.

 

On June 8, 1999, the City Council approved a consultant agreement with Creegan + D’Angelo for design and construction support services for the project in the amount of $288,900.  The term of this agreement will expire on December 31, 2001. This project requires the services of a structural engineering consultant like Creegan + D’Angelo because of design complexities associated with a bridge of this size and magnitude.

 

During the encroachment permit process, Santa Clara Valley Water District (SCVWD) requested additional design criteria to be incorporated into the project as a condition for the issuance of an encroachment permit.  These requirements were included in the consultant’s scope of services; however, negotiation with SCVWD is still on going and has taken much longer than anticipated.  Staff believes that the City will need the services of Creegan + D’Angelo until December 31, 2003.

 


ANALYSIS

 

In order to allow for permit negotiations with SCVWD and complete design and construction of this bridge project, it is recommended that the term of the agreement with Creegan + D’ Angelo be extended from December 31, 2001 to December 31, 2003.  Creegan + D’Angelo has agreed to this time extension at no additional cost to the City.

 

Continuation of this agreement to December 31, 2003 will not substantially delay the design and construction of the project.  This project is currently planned for award in March 2003, for  construction to begin in April 2003 and for project completion in December 2003.  Staff will continue to work with the Santa Clara Valley Water District to resolve all outstanding issues in order to assure project delivery.

This first amendment to the agreement has been coordinated with the Offices of the City Attorney, Risk Manager, Equality Assurance, and the Department of Transportation.
