FOR ADDENDUM
To extend an existing consultant agreement prior to its expiration on January 1, 2002.
Approval of the first amendment to the consultant agreement for the Alviso Environmental Education Center Remediation Project with URS Corporation, formerly known as “URS Greiner Woodward-Clyde International-Americas, Inc.,” extending the term of the agreement from January 1, 2002 to June 30, 2003, at no additional cost to the City.
In 1988, an Administrative Consent Agreement (Agreement) was executed by the United States Environmental Protection Agency (EPA) and the City of San José. The Administrative Consent Agreement requires the City to control the potential release of naturally occurring chrysotile asbestos from the serpentine rocks and soils that were placed, in berm and levee, on the grounds of the U.S. Fish and Wildlife Education Center in Alviso, by City contractors during heavy storms in December of 1982. This amendment will assist the City in fulfilling its obligations under the Administrative Consent Agreement.
The work to be performed at the Education Center is summarized as follows:
1. Removal of existing culverts in the levee adjacent to the Education Center and replacement of asbestos-containing soil with clean fill.
2. The replacement of a berm along the
east side of the access road to the Education Center with a berm containing
clean soil.
URS is familiar with the area and has the experience in testing and remediation work related to asbestos-containing soil. The agreement signed with URS’ predecessor on June 27, 2000 is to provide the design for the Alviso Environmental Education Center Project from July 1, 2000 to January 1, 2002.
Due to delays in obtaining special permits and conducting seasonal surveys on the breeding season(s) of the California Clapper Rail at the project site, it is necessary to extend the agreement to June 30, 2003 to cover consultant services through project completion. This will ensure consultant engineering services necessary to complete the project.
