Owner:
On
February 6, 2001, the San Jose City Council adopted the San Jose Abandoned Cart
Ordinance to reduce the number of carts abandoned on city streets, sidewalks and
parks. The ordinance is effective as of March 23, 2001.
All
businesses that may provide cart service for their customers use are included in
this mailing. If you have received this and either have no carts or less then
twenty-five, you are not subject to the ordinance and no further action is
required.
If
you are a business with twenty six or more carts, you will need to complete
and submit an Abandoned Cart Prevention Plan and pay a fee based on the number
of carts provided at the site. The fee for businesses with 26-100 carts is
$ 200.00. The fee for businesses with more then 100 carts is $200.00.
The
completed plan and appropriate fee, payable to the City of San Jose, must
be returned by mail to the Abandoned Cart Program, 170 W San Carlos Street,
4th Floor, San Jose, CA 95113 within 30 days from the date of the letter.

For
further assistance, the City of San Jose, in partnership with the Northern
California and California Grocers Associations will be conducting five seminars
on how to complete a prevention plan. The seminars will also provide the
opportunity to discuss questions directly with city staff and learn about what
has worked from industry representatives. You will find the list of these
seminars on the Frequently Asked Questions form.
All
prevention plan provisions are required to be implemented no later then June 27,
2001. Businesses that do not to return or implement an Abandoned Cart Prevention
plan will be subject to enforcement.
It
