Environmental Impact Report (EIR) Library

This page was created to allow the public an opportunity to participate in the environmental review process conducted by the City for public and private projects in San Jose. This process is mandated by State Law and explained in greater detail on this site.  Here you can track upcoming Environmental Impact Reports (EIR), download a Draft EIR, and submit comments electronically to the City. The EIRs listed below are either Draft EIRs in the public review and comment period, or final EIRs pending certification before the City Planning Commission. Each EIR listed below includes a brief project description, the public review period start and end dates, tentative Planning Commission hearing date, and contact information for the EIR project manager. The EIR documents include a table of contents, graphics, and technical appendices.  EIRs will be removed from the website after they are certified. Certified EIRs can be reviewed on Monday through Friday at the Department of Planning, Building and Code Enforcement, 200 East Santa Clara Street, 3rd Floor, San José CA 95113.

NORTH SAN PEDRO APARTMENTS PROJECT

File No. CP11-034. The proposed project would develop the site with 135 affordable for-rent residential units in a 75,626 square foot, six-story building, on a 0.73 acre site, located at the southeast corner of Bassett and Terraine Streets in downtown San José.

DIRIDON STATION AREA PLAN

File No. PP09-163 City Council- initiated project to create a transit-oriented land use plan for approximately 250 acres centered on Diridon Station, bounded by Lenzen Avenue and the UPRR tracks in the north, Interstate 280 in the south, the Guadalupe River and Delams Avenue in the east, and Sunol Avenue and Diridon Station tracks in the west.

THE SAN JOSE/ SANTA CLARA WATER POLLUTION CONTROL PLANT MASTER PLAN

File No. PP11-043. The Water Pollution Control Plant Master Plan project proposes a number of technical improvements to the San Jose/Santa Clara Water Pollution Control Plant and changes to the land use of the Plant’s 2,684 acres. The technical improvements include the Plant’s wastewater treatment operations, including changing the 700-acre biosolids dewatering and drying operations to a mechanical operation requiring less than 160 acres. The proposed land uses include future areas for WPCP and recycled water operations (629 acres), new roads and economic development areas (387 acres), flood control protection and environmental habitat restoration benefiting endangered and threatened species (1,190 acres), recreational facilities such as parks (42 acres) and trails (16 miles), and other uses (436 acres). Council District: 4.

ALMADEN RANCH RETAIL CENTER

File No. PDC10-006. Rezoning to A(PD) Planned Development Zoning District tp allow the development of 400,000 square feet of commercial development on an approximately 43 gross acre site located on the northeast corner of Almaden Expressway and State Route 85, with construction of a road through the site to connect to Sanchez Drive to the south.

NEWBY ISLAND SANITARY LANDFILL/THE RECYCLERY PLANNED DEVELOPMENT REZONING (File No.PDC07-071): to recognize the current landfill and related operations and practices and to increase the permitted top elevation of the landfill from 150 to 245 feet msl to allow an increase in the capacity of the landfill by approximately 15.12 million cubic yards, excluding cover materials. The project also includes some refinements to the existing site plan and incremental changes in operations that may be necessary for the remaining life of the landfill.

MOE'S STOP

The project consists of the application for a Conditional Use Permit to allow the demolition of an existing single family detached residence and the expansion of an existing gas and service station, consisting of the addition of three additional gas pumps and a canopy for the new pumping facility. Council District: 3.

THE ENVISION SAN JOSE 2040 GENERAL PLAN

The Draft Program Environmental Impact Report (PEIR) for the Envision San José 2040 General Plan, is available for public review and comment from June 17, 2011 to August 15, 2011. The Envision San Jose 2040 General Plan is a comprehensive update of the City's current Focus on the Future San José 2020 General Plan, adopted by the City Council in 1994. The City's General Plan is a long-term plan that describes the amount, type and phasing of development needed to achieve the City's social, economic, and environmental goals. The General Plan is the policy framework for decision making on both private development projects and City capital expenditures.

Figures contained in the PDFs of the Program EIR may need to be viewed on this website using the zoom feature (to 125%). Printed copies of the EIR with full size maps and figures are available at the main and branch libraries and at the Public Information Counter at City Hall during normal hours.

SUN GARDEN REDEVELOPMENT PROJECT, FILE NOs.: GP10-07-01 and PDC10-026.

General Plan Amendment to change the land use designation from General Commercial and Heavy Industrial to Combined Industrial/ Commercial and Rezoning to CG(PD) Planned Development Zoning District to allow the development up to a maximum of 282,300 square feet of commercial development on an approximately 20 acre site located on the east side of Monterey Road, south of the Monterey Road/Alma Avenue Intersection.

Addendum to the Flea Market EIR, File No. PDC09-006:

Planned Development Rezoning from A(PD) Planned Development Zoning District (File No. PDC03-108) to A(PD) Planned Development Zoning District to allow modifications to the General Development Standards, which include, elimination of prohibited uses, such as, "vehicle related uses" and "detached single-family and two-family dwellings" on a 120.4 gross acre site.

SINGLE-USE CARRYOUT BAG EIR, FILE NO. PP09-193.

Environmental Impact Report (EIR) for the Single-Use Carryout Bag Ordinance. The City of San José adopted an ordinance that consists of revisions to Chapter 9.10 of Title 9 of the City’s Municipal Code to prohibit the free distribution of single-use carryout paper and plastic bags at the point of sale for all commercial retail businesses in San José except restaurants and nonprofit charitable reuse organizations. An exception is made for paper bags containing at least 40 percent recycled content, which can be provided to customers for a minimum store charge of $0.10 upon adoption of the ordinance, with an automatic increase to $0.25 two years after the ordinance adoption.

Other Environmental Impact Reports

Additional certified Final EIRs  can be viewed at the Planning Division, 3rd Floor at San Jose City Hall on Monday through Friday from 8:00 a.m. to 5:00 p.m.  excluding public holidays. Copies are also distributed to the San Jose Main Library located at 150 E. San Fernando St. and to the neighborhood library nearest to the proposed project.
