  Sign Ordinance

Amendments to the Sign Ordinance

Amendments to Title 23 of the San Jose Municipal Code, Sign Ordinance, since the last print date of December 6, 2002.

Note: Copies of these ordinances can be obtained at the City Clerk's Office located at City Hall, 200 E. Santa Clara Street.

Programmable Display Signs in the Downtown Sign Zone:

Ordinance No. 28641 (Adopted 9-01-09, effective 10/02/09) This ordinance allows digital signs (programmable display signs) up to 35 square feet in area for large ground-floor spaces in the Downtown Sign Zone.

Projecting Vertical Signs in the Urban Mixed-Use Sign Zone:

Ordinance No. 28582 (Adopted 6-16-09, effective 7/17/09)  This ordinance revises the requirements for projecting vertical signs in the Urban Mixed Use Sign Zone.

Stevens Creek Boulevard Signage Area:

Ordinance No. 28569 (Adopted 6-02-09, effective 7/03/09)  This ordinance establishes the Stevens Creek Boulevard Signage Area and sets forth regulations for freestanding signs within this area. It allows larger and taller freestanding signs (up to a maximum of 40 feet in height and 150 feet in area) and allows additional freestanding signs for outdoor retail display frontages.

Projected Light Signs and Relocation of Historic Signs:

Ordinance No. 28144 (Adopted 10-23-07, effective 11/23/07) This ordinance amends the Sign Ordinance to allow projected light signsin the Downtown Sign Zone subject to specific parameters andto allow the Director of Planning to approve relocation of historic signs (signs that are listed on the Historic Resources Inventory) in a manner that preserves the historic sign.

Freestanding Signs on Large Lots and Arcade Signs:

Ordinance No. 28022.  (Adopted 5-8-07, effective 6-7-07) This proposal includes changes to the requirements for temporary signs, freestanding signs in specific commercial and industrial zoning districts, and gas station canopies; authorizes a new arcade sign; clarifies the requirements for programmable display kiosks in the Downtown Sign Zone; and clarifies that balloon signs are prohibited except where specifically authorized.


Skyline Signs within the Innovation Triangle:

Ordinance No 27910 (Adopted 12-5-06, effective 1-05-07) This ordinance provides greater flexibility for the location of allowed signage on buildings of less than 85 feet in height with a narrow street frontage in the area of the City north of U.S. 101 and west of Interstate Highway 880. 

Inflatable Signage:

Ordinance No 27864 (Adopted 8-19-06, effective 11-03-06) This ordinance allows inflatable signs in the Downtown Sign Zone subject to specific criteria which includes a minimum lot size of  7 acres, a minimum building area of 50,000 square feet, a maximum building height of 50 feet, a limit of one inflatable sign per parcel and a maximum sign size of 3,600 cubic feet.
Temporary Signage at Outdoor Events in the Downtown Core

Ordinance No. 27458 (Adopted 6/14/05, effective 7/15/05) This ordinance exempts signage related to outdoor events with a valid event permit in the Downtown Core from signage regulations.

Ordinance No. 27375 (Adopted 3/29/05, effective 4/29/05) The ordinance amendment expands the boundaries of the Downtown Sign Zone; includes regulations for mixed-use development; modifies skyline and rooftop sign provisions to apply citywide; modifies signage requirements for large multi-story retail uses; modifies fin sign, projecting sign, and three-dimensional sign provisions in certain areas; establishes a minimum base height for free-standing signs; and clarifies allowances for public outreach signs.

Sign Regulations for Commercial and Industrial Zoning Districts:

Ordinance No. 27034 (Adopted 12/16/03, Effective 1/16/04) This ordinance includes modifications to streamline, reduce and make more consistent sign regulations in industrial and commercial zoning districts (outside of the Downtown Sign Zone). This ordinance allows additional attached and free-standing signs and eliminates regulation in areas no longer necessary.

Skyline Signs and Roof Signs- Edenvale Industrial Redevelopment Area:

Ordinance No. 27018 (Adopted 12/2/03, Effective 1/2/04) Allows skyline signs and roof signs on buildings located within the Edenvale Industrial Redevelopment area in south San Jose.

Capitol Expressway Auto Mall Sign Ordinance Change:

Ordinance No. 26942 (Adopted 8/13/03, Effective 9/12/03)
This ordinance serves to recognize the Capitol ExpresswayAuto Mall Sign Zone, which is considered to be the segment of Capitol Expressway bounded by Almaden Expressway to just west of Highway 87. This ordinance creates signage regulations for this specific area, taking into consideration the unique characteristics of the area.
