Street Construction During Peak Commuting Hours

 

 

Summary of the Ordinance

San Jose Municipal Code, Chapter 11.14, prohibits construction activity that results in a lane closure on an arterial during Peak Commute Hours. The prohibition shall not apply when there is an emergency or the construction activity is performed under a valid City permit issued by the responsible department head which expressly grants an exception to the prohibition. Any person conducting operations under an emergency must file an Emergency Exception Report with the Director of Public Works within 48 hours of the time construction begins in violation of the limitation provided for in this Chapter.

Definitions

"Arterial" is defined as such by the Land Use / Transportation Diagram of the General Plan for the City of San Jose.

"Peak Commute Hours" means the hours between 6:00am to 8:30am, and between 3:30pm to 7:00pm, on Monday through Friday excluding "Holidays" as defined in the San Jose Municipal Code Section 11.04.040.  Please click here to see the full details of the Holidays.
