The City of San José establishes special landscape assessment districts to maintain improvements of a public nature that provide special benefits to the property owners served. These landscape improvements typically include items such as street islands with enhanced landscaping, fountains, plazas and other decorative features in the public right of way. Since the maintenance of these enhanced facilities directly benefit the individual parcels within the district rather than the City as a whole, the maintenance costs are assessed to the property owners within the Maintenance Assessment District boundaries.
There are currently 17 special landscape assessment districts in San José. The Department of Transportation Infrastructure Division is responsible for the maintenance of these districts. Currently, there are more than 275 acres of special district landscape.
Trees that are located throughout the districts, include but are not limited to, public right of ways, median islands, pocket parks, plazas and paseos, are all removed, replaced and maintained by the city of San José as part of the Special Landscape Assessment Districts services. The exception of this responsibility relates to residential street trees, as described in the San José Municipal Code Section 13.28 (PDF). There are two types of special landscape districts Community Facilities District (CFD) and Maintenance District (MD).
