San José City Council Enacts Temporary Eviction Moratorium

Post Date:03/18/2020 3:58 PM

On Tuesday, March 17, 2020, the San José City Council enacted a temporary eviction moratorium in response to the COVID-19 pandemic. In effect through April 17, with the possibility of an extension, the moratorium applies to all residential properties in San José. The moratorium only applies to residential evictions for nonpayment of rent when a tenant’s income has been substantially impacted by the COVID-19 outbreak.

While the moratorium is in effect, all residential properties in San José will be provided with Just Cause eviction protections, similar to protections provided to many renters under the Tenant Protection Ordinance.

Tenants and landlords are encouraged to visit the Housing Department’s Eviction Moratorium website to learn more about the ordinance, and view our list of frequently asked questions. If you require assistance or additional information, please contact the Rent Stabilization Program at 408-975-4480 or email RSP@sanjoseca.gov.
