Private Sector Checklist

To determine if your project is either, a) encouraged to certify or b) required to certify and submit a Green Building Refundable Deposit, please complete the following questionnaire:

Are you building nine or fewer single family homes or duplexes?

2. Are you building nine or fewer units of housing in a building less than 75 feet tall? Yes/No
3.  Are you building a commercial or industrial project that is less than 25,000 square feet? Yes/No Yes/No

 * STOP: if you answered “Yes” to this question, which means submission of a CHECKLIST IS REQUIRED per San José Municipal Code Chapter 17.84 Green Building Regulations for Private Development.  Yes/No
4.  Are you building a commercial or industrial building that is 25,000 square feet or more? Yes/No
5.  Are you building a residential project that includes 10 or more housing units? Yes/No
6.  Are you building a high-rise residential project that is 75 feet or taller? Yes/No
7.  Are you building a mixed-use project with 25,000 square feet or more of commercial/industrial space? Yes/No
   **STOP: if you answered “Yes” to this question which means CERTIFICATION IS REQUIRED per San José Municipal Code Chapter 17.84 Green Building Regulations for Private Development. Yes/No

IF A CHECKLIST IS REQUIRED:

Please submit the appropriate Project Checklist from U.S. Green Building Council or a GreenPoint Rated Checklist from Build It Green to the San José Permit Center when you apply for building permits for your project. The purpose of completing and submitting the checklist is to:

 

A) Meet the requirement of San José Municipal Code Chapter 17.84.220, Green Building Compliance Requirements; 

 

B) Encourage all applicants to consider and include green building strategies to reduce energy, water and material use; and

 

C)Encourage applicants to voluntarily certify their project.

Additionally, San Jose Municipal Code, Chapter 17.84.300 Green Building Refundable Deposit requires all projects that must certify to pay a deposit fee prior to issuance of any Building Permit. The fee will be refunded when a written request for the refund, accompanied by documentation of certification from either the U.S. Green Building Council or Build It Green, is submitted to the Permit Center.

PLEASE NOTE: Only projects to renovate or construct an addition to an existing building are automatically exempted from the requirements to submit a CHECKLIST or CERTIFY as stated in Chapter 17.84.220 Green Building Compliance Requirement.
