Forms for Tenants

The Tenant Petition form is used for the mediation/hearing process and the Petition Instructions will guide you filling out the Tenant Petition form in English, Spanish and Vietnamese. 

The Appeal Request or Breach of Voluntary Agreement can be filed by Tenants and Landlords who are against an administrative decision, a mediator written decision, a hearing decision, or to claim a breach of voluntary agreement. The appeal must be turned in writing on this form to the Rent Stabilization Program staff by the deadline

  • Appeals to Administrative or Hearing Decisions must be filed within 30 days. 6.06
  • Appeal to a Mediator Written Decision must be filed within 10 days. Regs.7.04.7
  • Appeal to a Hearing Written Decision must be filed within 30 days of the Mailing date of the Hearing Decision. Regs.7.14 
  • Breach of Voluntary Agreement must be filed within 90 days. Regs.7.04.6.

The Tenant Opposition Statement can be filed jointly by Tenants and Landlords on items that benefits tenant and landlord under the Regulations of the City of San José Apartment Rent Ordinance Chapter 10. The petition may be filed by the Tenant
