Meeting Purpose: Describe the proposed project, the City’s review process, and obtain community input on current Zoning Code Update (Accessory Dwelling Units, Deed Restricted Affordable Housing and Employee Housing, and Housing Element Residential Overlay District). Comments, concerns, and questions raised at this meeting will become part of the public record and will help inform the project’s design as it moves forward in the review process. There are continued opportunities throughout the approval process to publicly comment on the project.
The below changes help ensure that Zoning Ordinance is consistent with both statewide guidelines, Housing Element recommendations and aligns with goals and policies of the Envision General Plan 2040. No specific development proposals are part of this amendment to Title 20.
Project Description:
A. File No. PP22-002 - Deed Restricted Housing, Employee Housing, and Accessory Dwelling Units Update
(1) 100% Deed Restricted Housing: The proposed changes, consistent with prior City Council approved General Plan updates in December 2022, specify that commercial space requirements intended to create a mixed-use development will no longer apply to 100% deed-restricted affordable housing. These references will be incorporated within (a) Chapter 20.40, ‘Commercial Zoning District and Public/ Quasi-Public District,’ (b) Chapter 20.55, ‘Urban Village and Mixed-use Zoning District;’ (c) Chapter 20.70, ‘Downtown Zoning Regulations;’ and (d) Chapter 20.75, ‘Pedestrian Oriented Zoning districts.’; and
(2) Employee Housing: In accordance with California Health and Safety Code Sections 17021.5, 17021.6, and 17021.8, and Assembly Bill 1783- ‘Farmworker Housing Act’ of 2019, the proposed changes will incorporate text related to streamlined ministerial approval process for Employee Housing in Chapter 20.195, ‘Ministerial Approvals.’ This update does not propose any additional changes to current provisions for residential units; and
(3) Accessory Dwelling Units: The proposed changes will incorporate changes and update Accessory Dwelling Unit (ADU) regulations in accordance with current State law mandates. This update will repeal certain Sections of Part 2.5, Chapter 20.30, and relocate those ADU regulations to Part 2.75, Section 20.80 of Title 20 for better applicability. This update does not propose any additional changes to residential units except for incorporating current State law regulations; and
(4) Definitions: Add new definitions for ‘Housing, Affordable Deed Restricted Housing;’ ‘Housing, Employee,’ and incorporate edits to Section 20.200.324, ‘Dwelling-Junior Accessory Dwelling Unit or JADU.
B. File No. PP23-006 & C23-108 – Housing Element Residential Overlay Districts Zoning Update
(1) Incorporate minor edits to Section 20.65.010, and add new Section 20.65.180 in Chapter 20.65, “Overlay Districts”; and
(2) City initiated Rezoning to allow residential use by right for housing developments with at least 20% of units affordable to lower income households on 42 properties in the 5th Cycle Housing Element to comply with Government Code 65583.2.
