Americans with Disabilities Act (ADA)

• ADA curb ramps are graded ramps that lead from a sidewalk to a street.
• The ADA legislated them in an effort to allow people with disabilities such as those who use walkers, wheelchairs, or canes to have easier mobility in moving onto or off sidewalks and walkways.
• Other demographics that benefit from ADA curb cuts include cyclists, roller skaters, skateboarders, and parents pushing a baby stroller.

Curb Ramp Installation

• ADA curb ramps are built in all new developments and the City annually retrofits existing non-ADA compliant curbed intersections with ADA complaint ramps.
• The number of ramps built each year by the City depends upon the amount of funding available.
• Each year when consideration is given to the location of new ADA ramps, the highest priority is given to routes used by those with disabilities and areas surrounding senior and community centers.

Curbs & Gutters

A permit is required prior to performing any work on curb and gutter so that city inspection staff can confirm proper elevations of the new gutter prior to any work. Request a permit by emailing treesandsidewalks@sanjoseca.gov. Please include your name and contact information, property address, and a brief description of your request.

Curb & Gutter Permit Conditions:

• Remove one foot of street asphalt the entire length adjacent the curb and gutter repair.
• The city must inspect concrete forms prior to pouring concrete.
• Call at least 24 hours in advance of the desired inspection date.
• Concrete must be a six sack mix curing to 3000 PSI.
• After pouring the concrete and removing the concrete forms, backfill the removed asphalt area with base rock.
• City crews will replace the asphalt after the concrete work has passed final inspection.

Purpose

• Curbs and Gutters establish the grades for roadways and collect water from rains and runoff.
• Curbs provide a break or stop between roadways and pedestrian travel ways.
• Gutters typically move water from the roadway to storm water catch basins or drains.

Repairs

• Functionality is often hindered as a result of accident damage, deteriorating soil conditions, or tree growth.
• Property owners that are adjacent to damaged curbs & gutters are responsible for the cost to repair them.
