Meeting Purpose: To introduce the State and City requirements for Senate Bill 9 (SB 9), describe the proposed project, and to obtain community input to inform the creation of SB 9 Objective Design Standards. Comments, concerns, and questions raised at this meeting will become part of the public record and will help inform the project’s design as it moves forward in the review process. There will be continued opportunities throughout the creation and adoption process to publicly comment on the project.
Project Description: The State of California introduced Senate Bill 9 (SB 9) in 2021, to create opportunities for the construction of infill housing in low density residential areas.
SB 9 currently allows lot owners within the City of San Jose’s R-1 Zoning Districts (single-family residential) to split a parcel into two, and potentially create up to four homes on a lot. To regulate this development, the City applies rules within its Zoning Code call ‘standards’. The State requires these standards to be objective, measurable, and independently verifiable with no personal or subjective judgement.
Within the SB 9 project, the City of San José is creating a set of SB 9 Objective Design Standards (ODS) which will serve as a framework that can be applied to this type of infill development in R1 Zoning Districts. The project also includes an exploration of how SB 9 infill housing provisions might apply to the similar R-2 and R-M Zoning Districts.
