  • New Ordinance 30768 - An Ordinance of the City of San Jose Amending Chapter 12.06 of the San Jose Municipal Code to Extend the Campaign Contribution Period For Councilmember and Mayor Elections To 210 Days Before the Primary Election and To 60 Days After the Date of the Primary and Runoff Elections, and Specify that Funds Raised During the 60-Day Contribution Period After the Primary And Runoff Election May Only Be Used to Retire Campaign-Related Debts and Liabilities and that Any Solicitation for Such Contributions by A Candidate Or Candidate-Controlled Committee Must Indicate that All Contributions Received During this Period Will Be Used for this Purpose

 

 

 

INITIATIVES AND MEASURES

  • Resolution 80387: A ballot measure proposal to amend the San Jose City Charter to (1) move the mayoral election from the gubernatorial election cycle to the presidential election cycle beginning in 2024 and (2) to limit the person elected to the Office of Mayor in 2022 to a Two-year term with the option to run for the Office of Mayor and serve as such for two additional successive four-year terms.

  • Filer Access Portal
    The City of San Jose's Office of the City Clerk is pleased to offer a new online filing feature for our campaign financial disclosure. This portal will provide the capability for filers to complete and submit campaign finance disclosure forms online. It is an easy, convenient, and user-friendly way to file these forms. This new, free online service is available to any local committee, candidate, or officeholder that is required to file campaign disclosure documents with our office. This system will also accommodate Cal-Access filers who may use another professional software system allowing those filers to upload data from another system.

  • City of San José Office of the City Attorney
    The City Attorney’s Office provides legal interpretation of the San José Municipal Code regarding elections and ethics.
  • City of San José Board of Fair Campaign and Political Practices
    The San José Board of Fair Campaign and Political Practices monitors compliance with all campaign and ethics ordinances in the San José Municipal Code. The commission reviews and investigates allegations of violations of the Code and makes recommendations for enforcement action where appropriate.
  • Fair Political Practices Commission (FPPC)
    The FPPC is the State agency that enforces State laws regarding, among other things, campaign financing and spending, financial conflicts of interest, and gifts and honoraria given to public officials and candidates under the Political Reform Act. The FPPC provides written and oral advice to public agencies, candidates, and officials on the requirements of the Political Reform Act.   • Santa Clara County Registrar of Voters
    The Registrar of Voters (ROV) is the County Elections Official and the office conducts all Federal, State, County, Municipal, School District, and Special District scheduled and special elections. The ROV Office is also responsible for voter registration, education, and outreach; maintenance of registration files; verification of initiatives, referenda and recall petitions; and filing of campaign reports.
  • State of California Secretary of State Elections Division 
    The Elections Division oversees all federal and state elections within California. As the chief elections officer for the largest state in the nation, the California Secretary of State tests and certifies all voting equipment for security, accuracy, reliability, and accessibility in order to ensure that every vote is counted as it was cast. The Secretary also ensures election laws and campaign disclosure requirements are enforced, maintains a statewide database of all registered voters, certifies the official lists of candidates for elections, tracks and certifies ballot initiatives, compiles election returns and certifies election results, educates California citizens about their voting rights, and promotes voter registration and participation.

 

ABOUT THE OFFICE OF THE CITY CLERK

As the City of San Jose Elections Official, the City Clerk administers State, and Local procedures through which the City Councilmembers are selected. The City Clerk assists candidates in meeting their legal responsibilities before, during and after an election. From Election pre-planning and filing nomination paperwork to certification of election results and filing of final campaign disclosure documents, the City Clerk manages the process which forms the foundation of our City government.  The City Clerk does not provide legal interpretation or legal guidance on State rules or Local ordinances.
