LEARN ABOUT RENT STABILIZATION

The Rent Stabilization Program staff oversees rental housing ordinances in San José, and provides services to tenants and landlords. Among the many rental issues this team handles are eviction concerns, questions about allowable rent increases, tenant/landlord disputes, and much more.

NOTICES TO VACATE

The Tenant Protection Ordinance (TPO) covers most apartment buildings in San José. It specifies landlord responsibilities and tenant rights regarding notices to terminate (i.e., eviction notices). Under the TPO, landlords may only terminate tenancies for 13 just causes, and must follow specific procedures to lawfully terminate tenancies.

FILE A PETITION

The Apartment Rent Ordinance allows tenants who live in rent stabilized apartment buildings to file petitions when they have concerns about landlord actions. These petitions are typically focused on issues such as rent increases, habitability concerns, or service reductions. 

MEDIATION PROGRAM

The Housing Mediation Program provides landlords and tenants with a neutral platform for resolving disputes. This program is voluntary and there is no cost to participate. Many types of disputes are covered by the Housing Mediation Program. These include, but are not limited to, non-payment of rent, lease issues, nuisance issues, and roommate disputes.

VOUCHER PROTECTIONS

The Housing Payment Equality Ordinance prohibits discrimination against housing voucher holders who apply for rental housing in San José. The ordinance enables apartment applicants who receive financial assistance to be considered in an equal manner to all other applicants. The ordinance is intended to expand housing opportunities for voucher holders.
