Off-Sale Alcohol Program

The Code Enforcement Division enforces sections of San José Municipal Code to ensure that businesses that sell alcohol to be taken off premises are operating in a responsible manner.

Regulations

In December 2005, the City Council adopted amendments to San José Municipal Code Title 6 and Municipal Code Title 20 to regulate the sale of alcoholic beverages that are taken off the premises. An inspection program was created to ensure that retailers maintain their businesses in a responsible manner that meets code requirements and does not negatively impact neighborhoods.

Permits & Inspections

The Off-Sale Alcohol (OSA) permit must be renewed annually. Payment may be made online at SJPermits.org by following the steps in the Off-Sale Alcohol Program Payment Guide.

Retailers can prepare for inspections by reviewing the Off-Sale Alcohol Inspection Guide.
