San Jose Flea Market Southside Rezoning Project

On June 29, 2021, the City Council approved the San José Flea Market Southside Rezoning Project. This webpage provides the project's background, updates on implementation,  Vendor Support information and opportunities to get involved.

The property owner has submitted two applications that City staff are currently reviewing for consistency with the approved rezoning project:

SUMMARY OF APPROVED REZONING PROJECT

In June 2021, the City Council approved rezoning the site from A(PD) Planned Development Zoning District to CP(PD) Planned Development Zoning District. This allowed additional development than had been previously planned. The map below shows the type of future development allowed on the approximately 60.7-gross acre site, which includes:

  • up to 3,450 residential units (yellow areas);
  • up to 3,400,000 square feet for commercial uses (teal areas);
  • a requirement for 5 acres for an urban market (red area);
  • a 1.4-acre public park and additional open space (green areas); and
  • parking structures (grey areas).

Berryessa BART Urban Village Plan 

The project site is part of the 270-acre Berryessa BART Urban Village Plan, which the City developed at the same time it reviewed the Southside Rezoning Project. The Plan includes chapters on: Vision and Principles, Land Use, Open Space and Placemaking, Urban Design, Circulation and Streetscape, Parking, and Sustainability and Resiliency. The City held a series of community events to get input on the plan (these were in addition to the outreach held specifically for the rezoning project). Staff considered all input received through these processes when reviewing the proposed land uses, site layout, and development program in the rezoning application.

PROJECT IMPLEMENTATION

Redevelopment of a large project such as this typically happens in phases over several years. For each phase, the property owner must submit additional applications to the City for review. 

The City anticipates that the Flea Market will remain open, as is, for the near future. The approved rezoning project includes measures to support vendors leading up to and following closure of the existing Flea Market. 

Phased redevelopment. For each phase, the property owner must submit a development application with site plans and building designs to the City. City staff will review the plans and conduct an environmental analysis, including community engagement. This review process typically takes 12-18 months to complete, followed by additional months to issue the building permits. Then, construction could begin for that phase.  

The property owner has submitted two applications to the City that, upon approval, will establish the layout of development blocks, enable phased construction of site infrastructure (e.g., streets utilities, etc.) under future permits, and subdivide the site to align with those blocks, consistent with the site plan approved under the rezoning. The subdivision will enable the current property owner to sell the parcels to one or more developers. See the Active Applications page for more details. Property Owner's Quarterly Reports 

Per the approved rezoning project, the property owner is required to submit quarterly status reports to the City. The reports are intended to summarize construction, demolition and planning activities affecting the site, and to quantify any displacement of vendors. The City has received the following reports: 

Updates to the Community and Economic Development Council Committee  

Another requirement of the rezoning project is that Planning staff provide project updates to the Community and Economic Development (CED) Council Committee twice a year. Staff will share the property owner's quarterly status reports and staff’s progress in implementing the Flea Market Advisory Group and the Vendor Transition Fund. Presentation to the Berryessa Citizen Advisory Council (BCAC)

On June 12, 2023, staff from the Planning Division and Office of Economic Development and Cultural Affairs attended the monthly meeting of the BCAC to present an update on the Flea Market Rezoning Project and associated efforts to support vendors through the redevelopment process. The presentation included an overview of the applications currently under the City’s review and a summary of the requirements related to the 5 acres designated for an urban market on the project site. Following the presentation, Berryessa community members had the opportunity to ask questions and were encouraged to reach out to staff with any questions or comments. See the presentation slides

  • Attend CED Committee meetings that include an update on the Flea Market project.
