Micro Mobility Violations and Citations

Citations may be issued for violations of the Administrative Regulations. Citations may be issued based on audits, inspections, or data reports, and will be delivered to Operators on a monthly basis. Failure to address violations in a timely manner or an excessive amount of violations may result in additional fines, device impoundment, or permit revocation.

Examples of Violations and Resolution Guidelines

Some citations may be issued, and fines assessed, Per Occurrence (moving or parking violations) while others may be Per Day (that the violation persists). Enforcement Method may be automated (i.e. via Blue Systems) or through in-field inspections by City staff.

If violations are resolved within the grace period, a citation will not be issued. City staff will notify operators of certain violations, such as improper parking, after in-field inspections.

To avoid a fine, use the guidelines below to address violations in a timely manner.

Slow Zones (including Designated Area Sidewalks): 5 mph*

No Ride Zones

Improper Parking

Typical Enforcement Method: Automated
Counting Method: Occurrence
Geography: Citywide
Description: A device is deployed or parked in an improper manner, including but not limited to:
- Obstructing the right of way;
- Violating ADA guidelines;
- Impeding access to buildings, public facilities, utilities, or emergency facilities;
- Causing an immediate public hazard, or;
- In a manner otherwise inconsistent with the Administrative Regulations or the law.
Resolution: The device must be removed or re-parked within two hours of notification by City staff.
Grace Period: Two hours

No Parking Zones*

Typical Enforcement Method: Automated
Counting Method: Occurrence
Geography: Various (San José State University (SJSU), City parking garages, etc.)
Description: A device is deployed or parked in a prohibited area, including but not limited to:
- SJSU campus, excluding designated parking areas;
- 15 feet downstream or 65 feet upstream of bus stops*;
- Light rail platforms;
- City Parking Lots and Garages, or;
- Other areas designated by the City.
Resolution: The device must be removed or re-parked within two hours.
Grace Period: Two hours

Parking Time Limit

Deployment in Equity Priority Communities

Typical Enforcement Method: Inspection
Counting Method: Per Day
Geography: Equity Priority Communities
Description: The number of devices available in Equity Priority Communities falls below the minimum of 20 percent of total deployed devices by an Operator.
Resolution: Within two days, additional devices must be deployed in Equity Priority Communities or removed from other areas within the City until the 20 percent minimum is met.

Language Support (App/Web)*

Typical Enforcement Method: Inspection
Counting Method: Per Day
Geography: N/A
Description: English, Spanish, or Vietnamese language support is not available via an easy-to-find language button in the Operator’s customer-facing app, website, or web support page.
Resolution: Within seven days, language support with an easy-to-find language button must be added to the Operator’s customer-facing app, website, or web support page.
Grace Period: Seven days
Notes as of November 1, 2021: City staff may exercise discretion in the issuing of citations around Language Support and Data Connection violations, especially if a demonstrated effort is being made to comply with the relevant requirements.

Language Support (Phone)*

Typical Enforcement Method: Inspection
Counting Method: Per Day
Geography: N/A
Description: Callers cannot reach phone support in English, Spanish, or Vietnamese. Or, callers cannot reach phone support in Spanish or Vietnamese without first speaking English.
Resolution: Within seven days, language support that does not require callers to speak English must be added to the Operator’s phone support.

Data Connection*

Counting Method: Per Day
Geography: N/A
Description: Data is not transmitted to the City’s mobility management vendor as required by the Administrative Regulations.
Resolution: Within seven days, a working connection must be established and transmitting required data to the City’s mobility management vendor.
Grace Period: Seven days

Payment and Contestation of Citations

Operators may pay fines by mail, in person, or online. Operators may also contest citations by submitting a Hearing Request Application within 30 days.
