2023-2031 Housing Element

This page provides the Housing Element document and shows its progression through the phases of public feedback.

Following several rounds of public engagement, in late 2022, City staff submitted the Draft 2023-2031 Housing Element to the California Department of Housing and Community Development (HCD) for review. Upon completing its review, HCD issued a formal comment letter to the City. Read the letter.

Staff addressed the comments made by HCD in its letter, creating a Revised Draft 2023-2031 Housing Element, which was adopted by the San José City Council on June 20, 2023. HCD issued a second comment letter on Aug. 28, 2023.

Staff addressed the comments made by HCD in their Aug. 28, 2023 letter as well as comments made by stakeholders. This resulted in revisions to the Council-adopted 2023-2031 Housing Element, which stands as the “Adopted 2023-2031 Housing Element, Revised as of November 29, 2023” shown below.
HCD certified the 6th Cycle Housing Element on January 29, 2024. Drafts of the Housing Element are available below:

PROCESS

Staff conducted three phases of community engagement leading up to the release of the first Draft 2023-2031 Housing Element:

  • Fall 2019 to Spring 2020 - City staff engaged the public on Part 1 of the Assessment of Fair Housing (AFH).
  • Fall 2021 to Spring 2022 - City staff began Part 2 of the AFH, introduced the public to the Housing Element Update process, and asked for feedback on housing needs and goals.
  • Spring 2022 to Summer 2022 - City staff engaged the public on draft goals, strategies, policies, programs, and actions and continued the dialogue about fair housing concepts.

Staff also conducted data analysis and stakeholder engagement related to housing needs, progress with implementing the current 5th Cycle Housing Element, constraints on housing production, potential land to include in the residential site inventory, and other Housing Element requirements.

All 15 cities and towns in Santa Clara County are updating their housing elements. With funding support from the Association of Bay Area Governments (ABAG), the planning departments of these cities have formed a collaborative, Let's Talk Housing, to support public education on the Housing Element process.
